terms of use

Part A – General provisions

§ A1 Scope

(1) These General Terms and Conditions (terms) apply to all contracts between Fl’air Studios GmbH, Holzmarktstraße 15–18, S-Bahnbögen 51–53, 10179 Berlin (“Fl’air Studios”), and its customers regarding the use of the studio and participation in the offers of Fl’air Studios.

(2) Part A applies to all offers. In addition:

  • Part B applies to regular classes for adults (single classes, class packs, vouchers, memberships, private classes),
  • Part C applies to the kids classes “Kids got Fl’air”,
  • Part D applies to the Kids Camps,
  • Part E applies to the Teacher Trainings.

(3) Where Parts B to E deviate from Part A, they take precedence over Part A.

(4) These terms are binding for all users and visitors of Fl’air Studios. By entering the studio, every person also accepts the studio rules and all instructions given by studio staff for operational safety. Anyone who disregards these provisions may be temporarily or permanently denied access to the facilities of Fl’air Studios.

§ A2 Authorisation to use the studio

(1) Use of the studio and its facilities is subject to a charge. Only persons who have duly registered and paid are authorised to use the studio.

(2) Persons under the influence of intoxicating substances are prohibited from entering the studio and using its facilities.

(3) Children and young people may only use the facilities without supervision with the written consent of a parent or guardian. Parts C and D also apply to kids classes and Kids Camps.

§ A3 Opening hours

Opening hours can be found on our website www.flair-studios.de. Due to special events or important operational reasons, opening hours may deviate and studio operations may be restricted or suspended. Changes will be announced in good time in each individual case.

§ A4 Liability

(1) All visitors use the studio and its facilities at their own risk, without prejudice to the obligation of Fl’air Studios to keep the studio and its facilities in a safe condition.

(2) Fl’air Studios is liable without limitation for intent and gross negligence and for damage resulting from injury to life, body or health.

(3) In the event of a slightly negligent breach of an essential contractual obligation, Fl’air Studios is only liable for foreseeable damage typical for the contract. Essential obligations are those whose fulfilment makes the proper performance of the contract possible in the first place and on whose fulfilment the customer may regularly rely. Otherwise, liability for slight negligence is excluded.

(4) The limitations of liability under paragraph 3 also apply to the employees, coaches and vicarious agents of Fl’air Studios.

(5) Fl’air Studios is liable for valuables and items brought onto the premises, and for vehicles parked outside, only in accordance with paragraphs 2 and 3.

(6) Visitors are liable for damage they cause intentionally or negligently within the business premises.

§ A5 Behaviour in the studio

(1) Aerial fitness, aerial yoga, yoga, stretching and any other form of physical activity involve a risk of injury which, in the worst and extremely unlikely case, can lead to death. A minimum level of physical fitness, skills and coordination is essential to prevent injuries as far as possible. Please speak to our staff if you are unsure.

(2) Health restrictions, injuries or a pregnancy must be reported to the coach before the class starts.

(3) The studio is a barefoot area. Shoes must be taken off before entering the hall.

(4) Staying in the fall zone of other users is strictly prohibited. Mutual consideration is paramount. Everyone must behave in such a way that others are not endangered. Crash mats are available for fall protection.

§ A6 Order and hygiene

All facilities and equipment must be treated with care. Soiling of the mats must be avoided. Smoking is prohibited throughout the hall. Food may only be eaten in the designated areas. Visitors’ dogs are not allowed in the hall and must always be kept on a lead outside.

§ A7 Photos and videos

(1) Photos and videos in the studio are only permitted with the consent of everyone recorded, including the coach.

(2) Recordings of participants made by Fl’air Studios for promotional purposes require their separate consent, and for minors the consent of their parents or guardians. Consent can be withdrawn at any time with effect for the future.

Part B – Regular classes for adults

§ B1 Booking, cancellation and cancelled classes

(1) Classes can only be booked or reserved via our website at https://flair-studios.de/bookings/ and only against advance payment. Some classes require prior knowledge, as stated on our website. Classes marked Level 1 and higher are booked at your own risk. Fl’air Studios does not guarantee that the chosen level matches your abilities. If in doubt, please contact us in advance.

(2) Booked classes (including private classes) can be cancelled free of charge up to 24 hours before the class starts. Cancellations must be made in text form or directly via the booking system. One-off payments are then refunded to the original means of payment or credited to the customer account, at the customer’s choice. If an existing credit was used for the booking, it is credited back to the customer account.

(3) If a class is cancelled less than 24 hours before it starts, class fees are only refunded on presentation of a medical certificate. In all other cases not within the sphere of risk of Fl’air Studios, refunds are excluded.

(4) Classes take place subject to a sufficient number of participants at the discretion of Fl’air Studios. If Fl’air Studios cancels a class, any class fees already paid are refunded in full. Further expenses (e.g. travel and accommodation) are not reimbursed. Fl’air Studios informs participants without delay, usually no later than 4 hours before the class starts, by email and by text message if a valid mobile number is stored in the user profile. Short-notice cancellations due to illness or force majeure remain unaffected.

(5) To ensure classes run smoothly and punctually for everyone, the right to take part in a class expires when the class officially starts. It is therefore generally not possible to join a class that has already started. Exceptions are at the sole discretion of the coach. The obligation to pay the class fee remains unaffected.

(6) Fl’air Studios reserves the right to reduce its class schedule during public holidays and holiday periods or to close the studio temporarily. This does not give rise to a refund of fees paid. For closures of more than one week, the validity of class packs can be extended or memberships paused on request.

§ B2 Prices and price changes

(1) The prices stated on our website at the time of booking apply. All prices include statutory VAT.

(2) Single credits and discounted 5- and 10-class packs are valid for 6 months from the date of purchase and can neither be extended nor transferred to another person. Vouchers are valid for 6 months from the date of redemption. Regardless of this, they expire if not redeemed within 12 months of purchase.

(3) Any remaining credit expires at the end of the validity period. There is no entitlement to a refund or extension. Exceptions apply in case of illness or relocation if appropriate, current certificates are submitted without delay. Validity is then extended by the duration of the documented absence.

(4) Fl’air Studios reserves the right to adjust its prices. Users will be informed of price changes at least four weeks in advance in text form via the usual communication channels. Credits existing at the time of the price change remain valid for the class category for which they were purchased for the remaining validity period.

(5) Price changes for memberships take effect – once the minimum term has expired – from the next billing period, i.e. for monthly payments from the month following the announcement. In this case, members have a special right of termination at the end of the month in which the previous prices cease to apply. Price changes are excluded during the minimum term.

§ B3 Payment terms

(1) Class fees are due in full and without deduction at the time of booking. Only timely payment in advance entitles you to take part.

(2) Payment is made online via the webshop. Payment on site in cash or by card is only possible in exceptional cases; there is no entitlement to this.

(3) Membership fees are collected monthly in advance by SEPA direct debit.

(4) If a payment fails for reasons for which Fl’air Studios is not responsible (e.g. a returned direct debit due to insufficient funds), Fl’air Studios may charge a flat fee of €10 for the processing costs. The customer may prove that no damage or less damage has been incurred. Fl’air Studios reserves the right to claim higher damages.

(5) Consumers have the statutory rights of withdrawal in accordance with the separate cancellation policy.

§ B4 Memberships

(1) A membership entitles the user, against prior payment of the membership fee, to attend a certain number of classes per month depending on the chosen plan. Unused class visits expire without replacement at the end of the respective month. The conditions stated at www.flair-studios.de/memberships apply.

(2) The minimum term is six months. Termination before the end of the minimum term is excluded. During the minimum term, a change is only possible to a more expensive plan; afterwards, a change to a cheaper plan is also possible. Each change of plan starts a new minimum term.

(3) If the contract is not terminated or changed at least one month before the end of the minimum term, it is extended for an indefinite period and can be terminated with one month’s notice to the end of the respective billing month. Termination must be made in text form by email to info@flair-studios.de.

Part C – Kids classes “Kids got Fl’air”

§ C1 Registration and conclusion of contract

(1) The kids classes are for children and teenagers aged 8 to 17. Registration is made by a parent or guardian via the online registration form on our website.

(2) By registering, the registering person confirms that they have sole custody or the consent of the other person with custody.

(3) The contract is concluded when Fl’air Studios confirms the place by email.

§ C2 Trial lesson

(1) A trial lesson is required before joining a regular class. It costs €15 and is paid in cash or by card on the day of the trial lesson.

(2) During the trial lesson, the coach places the child in a suitable level.

§ C3 Class choice and allocation of places

(1) One or more preferred classes can be selected when registering. Fl’air Studios will try to take these preferences into account but cannot guarantee a specific class, time or coach. Places are allocated based on availability and the studio team’s assessment of the child’s level.

(2) Places are allocated in the order in which registrations are received.

(3) If Fl’air Studios cannot offer any of the preferred classes, an alternative class will be suggested. If the alternative is not suitable, the registering person may withdraw from the contract free of charge within 14 days of receiving the confirmation of place. Any amounts already collected will then be refunded in full.

§ C4 Term and termination

(1) The course year is divided into three trimesters: trimester 1 from January to April, trimester 2 from May to August, trimester 3 from September to December.

(2) The membership has a minimum term of one trimester. It is extended by a further trimester unless it is terminated no later than two weeks before the end of the current trimester.

(3) Termination must be made in text form by email to kids@flair-studios.de.

(4) Teenagers aged 16 and over may join adult classes instead with the consent of their parents or guardians. Adult prices and the conditions of Part B then apply.

§ C5 Fees and payment

(1) The fees stated on our website at the time of registration apply. They depend on the number of classes per week.

(2) The fees are flat rates across the whole year. They stay the same per month or per trimester, regardless of how many class dates fall within the respective period. Depending on public and school holidays, a trimester includes approximately 11 to 14 class dates.

(3) Payment is made either per trimester or monthly in 12 instalments per year. Monthly payment includes an administrative surcharge, the amount of which is shown in the price overview. Instalments continue during school holidays.

(4) Fees are collected by SEPA direct debit: for payment per trimester at the start of each trimester, for monthly payment monthly in advance, for the first time after registration. Before each direct debit, the registering person receives an invoice by email. § B3 (4) applies accordingly.

§ C6 Cancelled lessons and holidays

(1) There are no classes on public holidays or during Berlin school holidays. The dates are published on our website.

(2) Lessons missed by the child cannot be made up or refunded.

(3) If a lesson is cancelled for reasons for which Fl’air Studios is responsible, Fl’air Studios will offer a replacement date or refund the proportional amount.

§ C7 Supervision and health

(1) The duty of supervision of Fl’air Studios is limited to class time. Before and after class, it lies with the parents or guardians. The child must be dropped off and picked up on time.

(2) Illnesses, allergies and health issues must be stated when registering, and changes must be reported without delay.

(3) For safety reasons, tight-fitting clothing covering the midriff and armpits must be worn in class. Jewellery, watches, loose tops and shorts are not allowed. Long hair must be tied back.

§ D4 Cancellation by Fl’air Studios

(1) Camps take place subject to a sufficient number of participants. In this case, Fl’air Studios will inform participants no later than 7 days before the camp starts.
